Terms of Use for the “Polkadot” App

1. Early Access Status

This mobile application is currently in Early Access Testing. As an early access user, you acknowledge and agree to the following terms:

1.1 The application is a pre-release version and may contain bugs, errors, or incomplete features. We are actively developing and improving the application and appreciate your participation in this process.

1.2 At the completion of the application early access testing, this version of the application will cease to function. Please ensure no personal funds are added to the application for testing purposes.

1.3 Users are encouraged to report any technical issues, bugs, or unexpected behaviors directly through the application's feedback mechanism or support channels.

2. Risk Acknowledgment

2.1 Code Audit Status
The application's source code has not yet undergone a comprehensive third-party security audit. As such, users assume all risks associated with using this application.

2.2 Financial Limitations
We strongly advise users to not store their own financial assets within the application during this early access phase. While the product allows for users to purchase, transfer or interact with their own funds, users should exercise extreme caution and only use funds provided by the Polkadot Community Foundation for testing purposes. The Polkadot Community Foundation and its authorised representatives are not responsible or liable for any loss that results from using the Polkadot App during this early testing phase.

3. Geographic Restrictions

3.1 Permitted Jurisdiction
This application is exclusively authorized for use within the United States. Any access or use from outside the United States is strictly prohibited.

3.2 Geographic Compliance
By accessing or using this application, you confirm that:
- You are physically located within the United States
- You are a United States resident or citizen
- You comply with all applicable United States legal and regulatory requirements

4.1 By using this application, you agree to:

6.1 To the maximum extent permitted by law, the Polkadot Community Foundation shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of this application.

7. Changes to Terms

7.1 We reserve the right to modify these terms at any time. Continued use of the application constitutes acceptance of any updated terms.

8. Polkadot App Responsible Party

8.1 This Polkadot application, and all content herein, is controlled and maintained in all respects by the Polkadot Community Foundation. For clarity, Distractive, Inc., a Delaware corporation (“Distractive”) and the operator of the Polkadot website located at https://polkadot.com/ (the “Website”), has no control over and is not responsible for any such content on the Polkadot application now or at any point in the future. Further, all users of the Polkadot application agree to forever release and hold harmless Distractive from any claims related in any way to this Polkadot application and/or the content herein. For further clarity, Distractive cannot guarantee that user information will be treated under the Polkadot application as it is treated by Distractive through users’ access to the Website.
